પંજાબ અને હરિયાણા હાઈકોર્ટનું કહેવું છે કે, યૌન સંબંધ માટે પૂર્વમાં ભલે સહમતી હોય પણ ભવિષ્યમાં તે દર વખતે લાગૂ પડતી નથી. પછી ભલે ને અગાઉ સહમતીથી બંને વચ્ચે બંધાયા કેમ ન હોય. એક રિપોર્ટમાં જણાવ્યા અનુસાર જસ્ટિસ વિવેક પુરીએ કહ્યું કે, ના તો મતલબ ના છે. પછી ભલેને શરૂઆતમાં હા કેમ ન પાડી હોય. તેમણે કહ્યું કે, સહમતિ પાછી લેવી પૂર્વમાં આપેલી સહમતીને ખતમ કરી દે છે એટલા માટે બળજબરીપૂર્વક યૌન સંબંધ બનાવવું અસહમતિથી બનેલા સંબંધો કહેવાશે, જે આઈપીસીની કલમ 376 (બળાત્કાર) અંતર્ગત દંડાત્મક છે. જસ્ટિસ પુરીએ આ ટિપ્પણી એવા મામલામાં આપી છે, જ્યાં 35 વર્ષિય એક છૂટાછેડાવાળી મહિલાને એક શખ્સે તેની મરજી વિરુદ્ધ યૌન સંબંધ બાંધવાનો આરોપ લગાવ્યો છે. આ શખ્સ અગાઉ મહિલા સાથે લિવ ઈન રિલેશનશિપમાં રહી ચુક્યો છે. મામલાની અરજી દાખલ કરનારા આરોપીના વકીલે તર્ક આપ્યો હતો કે, મહિલાએ પ્રેમ સંબંધમાં નિષ્ફળ જતાં બળજબરીપૂર્વક વસૂલીના ઈરાદા સાથે આ કેસ દાખલ કર્યો છે અને બંને લોકો પૂર્વમાં સહમતિથી બનેલા સંબંધોના આધારે મામલો બનાવાની કોશિશ કરી. જસ્ટિસ પુરીએ એવું કહીને આ વાતનો જવાબ આપ્યો કે, એ સાચુ છે કે, કાયદામાં લિવ...
લોક અદાલતો કોર્ટ નથી- સુપ્રીમ કોર્ટે
સુપ્રીમ કોર્ટે એક મહત્વના ચૂકાદામાં જણાવ્યું હતું કે લોક અદાલતો કોર્ટ નથી કેમ કે તે વિવાદની પતાવટ કરવા માટે કાનુની રીતે ન્યાય તોળતી નથી. આથી તેમના દ્વારા આપવામાં આવેલા પતાવટના આદેશને કાયદેસરની અદાલત સામે દાખલા તરીકે ટાંકીને સમાન ધોરણે વળતર ન માગી શકાય. નોઇડા ઓથોરિટીએ માર્ચ 1983માં એક જાહેરનામું બહાર પાડીને દાદરી તહેેસિલમાં આવેલી જમીનનું એધિગ્રહણ ઔદ્યોગિક વિકાસ માટે કર્યું હતું. નવેમ્બર 1984માં જમીનમાલિકોને ચોરસ મીટર દીઠ 20 રૂપિયાના ભાવે વળતર આપવામાં આવ્યું હતું. એ સમયે જમીન માલિકોએ વળતરના દર સામે કોઇ સવાલ કર્યા વિના વળતરને સ્વીકારી લીધું હતું. પરંતુ એક ફતેહ મોહમ્મદે આ એવોર્ડ સામે અરજી નોંધાવી હતી જેેનેે પગલે નોઇડા ઓથોરિટીએ 2016માં ચોરસ મીટરના 297 રૂપિયાના ભાવે વળતર આપવાનું ઠરાવ્યું હતું. આ રકમ લોકઅદાલતે 30 વર્ષ પૂર્વે અપાવેલા વળતર કરતાં પંદર ગણુ વધારે હતું. આ જોઇ અન્ય જમીનમાલિકોએ પણ અલ્હાબાદ વડી અદાલત સામે લોકઅદાલતનો આદેશ ટાંકીને તેના જેટલું જ વળતર મેળવવા માટે અરજી નોંધાવી હતી. પણ નોઇડાએ હાઇકોર્ટના આદેશને સુપ્રીમમાં પડકારતાં સુપ્રીમે નોઇડા ઓથોરિટીની તરફેણમાં ચૂકાદો આપ્યો હતો.
